If you are obliged to attend Court to answer a serious criminal or traffic charge, it is strongly recommended that you first obtain competent legal advice from a criminal lawyer on your rights and responsibilities associated with such charge.
You have an irrefutable right to insist that the police or other prosecutor present formal evidence to the Court to prove your guilt beyond reasonable doubt.
If you plead guilty to any criminal or traffic charge, you initiate a criminal or traffic police record or add to it if you already have one.
Your criminal or traffic record might be used against you in any personal injury or property damage claim arising out of the same circumstances.

If you wish to withdraw a police charge laid against you, or someone else, an application must be made in writing

If you proceed yourself with this difficult legal process, your Application must be addressed to the Commander of the Police Station were the Police Informant works
The Police Station where the police officer is stationed will be mentioned in the Court Attendance Notice ("CAN")
For instance, if you were charged by Constable Joe Smith (referred to as the "OIC Prosecutor" in the CAN) from Eastern Suburbs Police Station, your Application should be addressed to..

Do not contact the Police Informant personally requesting that the matter be withdrawn or address any written Application to him or her
The Commander will acknowledge receipt of your Application and the decision making process regarding your Application for withdrawal will commence

Your name, and relationship, if relevant, to the Defendant.
The reason you think the charge should be withdrawn.
The type or title of the offence you want withdrawn.
The date the Defendant was charged OR the date the matter is going to Court.
The name of the Police Officer who laid the charge and where he or she is stationed.
The charge reference number, which is the number beginning with the letter "H" in the top right hand corner of the paperwork or CAN. For example, "My husband Col Brown was charged with an assault on me (H123456789) at Waverley Police Station on the 1.1 07. I would like the Police to consider withdrawing the charge of assault because....."
Include the date of your Application beneath your signature, and a return address and contact telephone number.
